General terms and conditions AGB`s ( Webshop DIVISTO )

We are very pleased that you are ordering a product from our DIVISTA web shop. Please read our general terms and conditions below carefully. They apply to all of your orders.

 

1. Scope and conclusion of contract
These terms and conditions apply to sales contracts between you and divisto.com, operated by INTRAKUSTIK bruppacher c / o BOP bruppacher office project, Postfach 263, 3172 Niederwangen, tel: +41 31 558 20 21, email: info@intrakustik.ch.

The order is confirmed by us. Your order is binding as soon as you have clicked on the order button at the end of the ordering process.

 

2. Range and prices
We are constantly adapting our range to the latest technical standards and possibilities. The latest prices and shipping costs that can be seen online at the time of the order apply. Price changes and errors are reserved.

 

3. Order
All orders are fundamentally binding. By completing the order, you confirm that you have checked your entries and that the order data transmitted is correct. After the order has been completed, production data can no longer be changed or can only be changed against payment of the costs already incurred. Please note that orders can neither be deleted nor merged after they have been sent. Processing of your order usually starts on the same or the following day. We reserve the right to reject orders without giving reasons.

 

4. Delivery
The current delivery times and shipping options at the time of the order can be viewed online. In the event of delivery obstacles on our part, we will contact you immediately by email or phone. If we inform you about delivery obstacles, you can cancel the order free of charge.

 

5. Warranty and liability
We assure you of a professional and high quality execution of your orders. We also endeavor to keep our very short delivery times at all times. If, in exceptional cases, we cannot maintain the agreed quality of our services, no claims can be derived from this.

We expressly reject any liability for damage that could be derived from the use of our service and the use of the products. You are responsible for ensuring that the products are used and attached correctly and correctly. Instructions and special product information that we provide online for the products must be carefully observed. Any claims for damages are limited to the pure material value. Further claims are excluded.

 

6. Right of return
Transport damage:

In the case of obvious transport damage, please contact the transporter immediately and request a damage form, as the transporter, as our logistics partner, takes over such damage and processes it directly with you.

In the event of total or partial destruction of the product through improper handling / attachment after acceptance of the transport, there is no right to a free replacement.

Production defects:

If the delivered product shows obvious production defects, please contact us immediately so that we can discuss the next steps with you. Please do not send any products back without prior consultation with us.

 

7. Payment
We deliver our products on account. After placing your order, an advance payment of 50% is due. After delivery, the remaining amount is due. All invoices are payable net 10 days after receipt. We reserve the right in certain cases to deliver only on prepayment or cash on delivery. Any reminders will be sent electronically via email to your address or by post to the billing address you provided. The default interest is 7%. As of the second reminder, we reserve the right to charge a reminder fee of CHF 25. After the 3rd reminder, we hand over the claim to a debt collection company. A reminder fee of CHF 50 then applies for each additional payment reminder. All delivered goods remain the property of INTRAKUSTIK by BOP bruppacher office project until they have been paid for in full.

 

The goods are only ordered from the manufacturer when payment on account has been received, unless INTRAKUSTIK by BOP bruppacher office project and you have agreed other payment terms in advance in writing.

 

8. Application of law / place of jurisdiction
In the event of a dispute, Swiss law is exclusively applicable. The place of jurisdiction is Bern.
